Former West Alton Marina Co-Owner Seeks New Trial
The former co-owner of the West Alton Marina who was convicted of sexually assaulting a teenage employee is seeking a new trial based on alleged juror misconduct, News 9 Investigates has learned.
Brian Fortier, 52, was convicted in January of aggravated felonious sexual assault and felonious sexual assault.
At his sentencing Fortier denied the charges against him, and on April 23, his attorneys filed a motion for a new trial based on alleged juror misconduct.
Fortier has also appealed his case to the New Hampshire Supreme Court.
On April 30, the state Supreme Court stayed that appeal, pending the outcome of the motion for a new trial.
Fortier was sentenced to three to seven years in prison.
